Settle The Score
An 83 year-old man went into long term care in 2022. He had 3 children and they were all Powers of Attorney for him. His grandson moved into his house shortly after and lived there for 2 1/2 years rent-free until his daughter sold her house and moved in with him. She wanted to purchase the house from him for $30,000 less than fair market value while acting as his Power of Attorney. One of the siblings refused to sell it to her for this price, as you need to act in the best interest of the person you are Power of Attorney for and she knew their dad wanted his property divided equally amongst his children (in the will too), so it did not take place. Then, when her dad passed away, a house appraisal needed to be done for the will. A renovation of the downstairs bathroom showed up in the appraisal, much to the surprise of her siblings. The house was appraised at $20,000 more than before but the daughter expected to have $21,000 taken off the price for her renovation. When the same sibling as before refused to do this, the 2 siblings settled on a price that included the return on investment for the bathroom renovation. It took their dad approximately 3 months to get used to long term care without wanting to return to his house. The daughter who is currently living at his house still has not paid for the house (has to go through probate now) and does not want to pay for the house costs for the 2 1/2 years her son stayed there. One sibling is currently feeling bullied by the daughter living in their father's house.

They all seem to care far less about the passing of the father/ grandfather and MUCH more about their inheritance. Did they visit dad and granddad in the care facility? VERY SAD when relatives fight over money from a relative who has passed. But it happens all the time.

Since the one sibling did renovations on her own, the siblings should sell the house and divide the property equally to someone other than the sibling living there since she hasn't paid anything for the house. I don't think they'll be able to get house costs back for the grandson living there for 2 and a half years other than taking the cost out of his mother's share when they sell the house.

First, NEVER have more than 1 POA...or it leads to disagreement. Unfortunately ALL must agree. The renovation should NOT have been done in the first place without the consent of all 3. It is fair to include the cost of this in the settlement though since it came out of only one person's pocket.

To start with; if there is a will, there is a war. I have just gone through it myself and it can get very ugly, very fast. There are a few things that have been left out of the story, such as the grandson that lived there for 2 1/2 years prior, did he become grandpa's care giver? If so that changes things. If they refuse to do so- the property goes on the open market and when it sells each gets one-third of the money. There should have been one executor for their dads estate who would carry out exactly what the will states and act accordingly. My mom recently passed and my brother is the executor of her will and is following my mothers wishes to the exact of what the will states and she had also discussed this with myself and my other brother and sister and we were all in agreeance and there are no problems what so ever, but to have 3 as executors? I think the other 2 siblings need to sit down with a lawyer at this point and come to some sort of a permanent agreement with documents signed so no one else can change things.

The house should be sold for fair market value (whether the one sibling buys it or someone outside the family.) IF the sibling living in the house did the reno, that sibling should get that money back after the sale (or pay that much less for the house if she was the one who paid for the reno initially. If DAD paid for the reno, she owes that amount back to the estate.) Also, fair rental amount should be calculated and the daughter & her son should have to reimburse the estate for that (keep in mind that 1/3 of those funds would come back to her since that rent should be distributed to all 3 kids and that daughter is one of the 3.

Hardly a typical situation. But it seems that the siblings are prepared to talk to each other. If they can't work out a compromise then perhaps they would agree to independent mediation. Professional mediators (often lawyers) are probably available in their area.

I think whoever took care of the father for long term and did everything asked.of them should get the house and pay what they can.come to terms with. My husband and his siblings went through the same thing.. so.i dont know what to tell other people who go through the same thing. We (husband and myself) took care of his parents everyday and the other siblings said they never had time to come and help take care of them, but in their passing, they all thought they should get everything from them and the house.

When my mom passed away, there were 4 kids, and our oldest sister was put in charge. It was an old house, over 100 years old, which my dad had added to many years ago, more than doubling the size of the original house. The house was appraised for current value, and the proceeds were split 4 ways and divided equally. That is how it should be done. These days, often if there is more than one beneficiary, there are problems! One will often think they deserve more. It is the current way of the world, sadly! Everyone is out to get everything for themselves! I feel the correct way is to have the appraisal done and split evenly. If one person did have upgrades done that increased the value overall, then their costs may be recouped, but no amount of money can make up for destroying the family over something as petty as money!!!

No one should have been allowed to live in the house until an agreement was drawn up by all siblings as to how all updates/renovations/bills/taxes, etc would be handled. Now...since the house does NOT belong to the one living there, she should have to move out until this is figured out and all 3 people who inherited the house will split the maintenance and bills for the house until an agreement is reached. Get a mediator if needed.

POA is active only during the life of the person granting the POA. A POA terminates on death. The Executor of the estate should get a couple appraisals and offer it to the sibling who wants to buy at the appraised price. If the sibling doesn't want to buy at the appraised price the house should be listed for public sale.

First, regardless of who is living in his house the will, hopefully, shows who the house is being left to and if it is to the three siblings to split equally then that is what should happened. And it does not matter that one of the siblings son was living there regardless whether it was rent free or not. This one sibling had no right to want to buy it for 30k Less. She wants to buy the house she needs to split the fair market value three ways. Give the other two siblings there share and finance the rest. Don't know what the actual will says nor what state laws are but that's how I see it

House should be appraised by an independent appraiser to determine fair market value. Daughter gets nothing for bathroom renovation (assuming she did not tell siblings she was doing this. Siblings should offer her not having to pay for house costs the time her son lived there. Daughter should start paying rent immediately, rent to be put in escrow. When probate is done, house should be sold. If any of the three siblings want to buy the other two out, the best offer equal to or greater than appraised value gets the house. Escrow can be divided among the three. Daughter should have no more say in the process than the other two siblings.
