The top court in Canada, the Supreme Court has ruled law societies around the country can refuse to give accreditation to graduates from Trinity Western University's proposed law school in Langley, B.C. The top court says the societies need to protect the values of equality and human rights in carrying out their functions. One deciding factor was the university's proposed community covenant banning students from having sex outside heterosexual marriage. The students would have to sign a commitment to refrain from any sexual activity "that violates the sacredness of marriage between a man and a woman.". This case pits two significant societal values — freedom of religion and promotion of equality — against one another. In this case, promotion of equality trumps religious rights. Proponents of this ruling argue that "being required by someone else's religious beliefs to behave contrary to one's sexual identity is degrading and disrespectful." The university fought and won a similar legal battle in 2001, when the Supreme Court of Canada ruled the B.C. College of Teachers could not deny accreditation to TWU education graduates because of the community covenant. However, the Canadian Civil Liberties Association, which is among 26 interveners in the current case, has said the covenant offends modern concepts of equality and privacy.
