Flick was released 9 years early for good behavior. But in 2008 he was jailed for stabbing a woman with a fork. And in 2010 in another case of domestic abuse he put a woman in a headlock and struck her repeatedly with the butt-end of the handle of a steak knife. When she knocked the knife away and ran, Flick chased her down the street with a screwdriver. At this point it could be claimed he violated his probation, committed felony assault, and tampered with a witness by threatening, "You'll get yours". Does this seem like a career criminal?

At Flick's hearing in 2010, his probation officer and the procecutor both pressed for an 8-year sentence because Flick's extremely violent behavior was ongoing. But a Maine Superior Court Justice sentenced Flick to just 4 years. Noting that the defendant would be 72/73 when released in 2014 he ruled, "At some point Mr Flick is going to age out of his capacity to engage in this conduct, and incarcerating him beyond the time that he ages out doesn't seem to me to make good sense from a criminological or fiscal perspective". Do you agree with the judge's theory?
