Key allegations include: Approval despite warnings: Senior officers in the IDF’s Gaza Division and Shin Bet expressed concerns about holding the event near the Gaza border, especially with many soldiers on leave for the Simchat Torah holiday, yet approval was granted. Failure to act: Despite situational assessments held on the night of October 6–7 indicating a high likelihood of an attack, authorities failed to order the party’s closure or the dispersal of attendees. Security failures: The suit notes that only 27 police officers were stationed at the event, most without long arms, and that intelligence warnings about potential infiltration were ignored. The plaintiffs, represented by attorneys Anat and Gilad Ginzburg, argue that this negligence resulted in the deaths of 364 participants and the kidnapping of 40 others, seeking compensation for loss of earnings, pain and suffering, and medical expenses.
