Results: Would you have this student arrested?

I have a good friend of mine who's daughter is a High School Chorus teacher. She said today some student had stolen her daughter's cell phone off her desk. Luckily her daughter had downloaded the tracking on her Iphone5. She had a list of the kids names and addresses and so it ended up being one of the male students. She told the Principal, he then called the student and the student said he gave it to someone. The Principal said you bring the phone back in the morning and it better be in the same shape as it was in. I told my girlfriend I would have had him arrested. He already had a monitor bracelet on his ankle.
