In 1960, the Supreme Court, in a 6-3 decision, decided that there is no contract or guarantee that Social Security be paid out to recipients thus opening the trust to congressional shenanigans. In 2023, there was a bill introduced to the House by Doug LaMalfa R-CA on 1/25/2023 called House Bill 521, the Social Security Guarantee Act of 2023 with the purpose of seeking to ensure Social Security beneficiaries receive their full benefits and that these benefits are adjusted annually to reflect cost-of-living increases. The key provision is to require the Department of the Treasury to issue certificates guaranteeing the full monthly benefit amount and annual cost-of-living adjustments. It was then referred to Ways and Means on 1/25/2023 where it languished until 12/17/24 when it was referred to the Subcommittee on Social Security.
