Results: Judge grants Scott Peterson status hearing after LA Innocence Project filings

Laci Peterson, who was 27 years old and eight months pregnant, disappeared on Christmas Eve in 2002. Her body was found in San Francisco Bay in April 2003. In their filing, attorneys with the LA Innocence Project claimed that Scott Peterson's state and federal constitutional rights were violated, including a "claim of actual innocence that is supported by newly discovered evidence," according to the court filings. "New evidence now supports Mr. Peterson's longstanding claim of innocence and raises many questions into who abducted and killed Laci and Conner Peterson," the filings state. Scott Peterson, who pleaded not guilty, has maintained his innocence and claimed he received an unfair trial based on possible jury misconduct. Scott has always maintained his innocence and his lawyers claimed at trial Laci was kidnapped and killed as she walked the couple's dog after he left to go on a solo fishing trip on Christmas Eve morning. The bodies of Laci and Conner washed up four months after she disappeared, and prosecutors called to the stand a hydrologist who said their bodies would have likely been dumped in the area where Scott said he'd gone fishing that morning. Prosecutors also claimed Scott made cement anchors to weigh his wife's body down in the bay. Prosecutors also said blood was found on the couple's bedspread and on the door of Scott's truck, and hair strands supposedly belonging to Laci were found on Scott's newly purchased boat and DNA from a set of pliers matched Laci's DNA. Peterson also was having an fair and told his mistress he didn't want kids. However, the defense said that there were no witnesses, no murder weapon, and no evidence of a struggle that led to Laci's death.
