U.S. prosecutors are recommending to senior Justice Department officials that criminal charges be brought against Boeing (BA.N), opens new tab after finding the planemaker violated a settlement related to two fatal crashes, two people familiar with the matter told Reuters.

In May, officials determined Boeing breached a 2021 agreement that had shielded it from a criminal charge of conspiracy to commit fraud arising from two fatal crashes in 2018 and 2019 involving the 737 MAX jet where over 300 people died. Under the 2021 deal, the Justice Department agreed not to prosecute Boeing over allegations it defrauded the Federal Aviation Administration so long as the company overhauled its compliance practices and submitted regular reports. Boeing also agreed to pay $2.5 billion to settle the investigation. Federal prosecutors wrote that Boeing "breached its obligations" and allegedly failed to "design, implement, and enforce a compliance and ethics program to prevent and detect violations of the U.S. fraud laws throughout its operations." Boeing has told the Justice Department it disagrees with its determination that the company violated the settlement. The Justice Department must decide by July 7 whether to prosecute Boeing. As part of an ongoing investigation, Boeing whistleblowers told the Senate in April that the 737 Max, the 787 Dreamliner and the 777 models had serious production issues. A whistleblower report from June raised concerns that Boeing was using faulty parts in the construction of its jets. In March, John Barnett, 62, died in Charleston, S.C., "from what appears to be a self-inflicted gunshot wound," the local coroner said. At the time, Barnett had been testifying in his retaliation lawsuit against Boeing. In May, Joshua Dean, a former quality auditor at a key Boeing supplier who raised concerns about improperly drilled holes in the fuselage of 737 Max jets, died of a MRSA bacterial infection.
