Lawyers for Republican and independent voters who sued to remove Trump's name from the Colorado ballot had argued that there is ample evidence that the events of Jan. 6 constituted an insurrection and that it was incited by Trump, who had exhorted a crowd of his supporters at a rally outside the White House to "fight like hell." They said it would be absurd to apply Section 3 to everything but the presidency or that Trump is somehow exempt. Section 3 of the 14th amendment of the Constitution states: "No person shall be a Senator or Representative in Congress, or elector of President and Vice-President, or hold any office, civil or military, under the United States, or under any State, who, having previously taken an oath, as a member of Congress, or as an officer of the United States, or as a member of any State legislature, or as an executive or judicial officer of any State, to support the Constitution of the United States, shall have engaged in insurrection or rebellion against the same, or given aid or comfort to the enemies thereof. But States have no power under the Constitution to enforce Section 3 with respect to federal offices, especially the Presidency," the Court wrote. Basically, this is a Federal issue and States should not be able to decide if a candidate for President, a Federal office, is allowed on a State ballot. Conservative Chief Justice John Roberts said if the Colorado decision is upheld, other states will proceed with disqualification proceedings of their own for either Democratic or Republican candidates. "And it will come down to just a handful of states that are going to decide the presidential election. That's a pretty daunting consequence," Roberts said.
